The California Business & Professions Code defines home inspection as:
“a noninvasive, physical examination, performed for a fee in connection with a transfer, as
defined in subdivision (e), of real property, of the mechanical, electrical, or plumbing systems or the structural and essential components of a residential dwelling of one to four units designed to identify material defects in those systems, structures and components. ”In addition, Home Inspectors are strictly prohibited from doing repair work on any property that they have inspected within the prior 12 months.
New legislation has been proposed in 10 of the last 12 years, though no new laws are currently forthcoming.
The fact that registration, certification or licensing is not required does not alleviate you of the responsibility to know what you are doing and it is almost inevitable that legislation will one day be a reality. You can be ahead of the law by preparing yourself with the education necessary to insure you can be licensed when it becomes law, to assure your potential clients of your ability to perform a meticulous and accurate home inspection, and to be able to advertise your education in order to attract new business.
